CLP, ATP 18

ATP 18 has been amended in May 2022. The transition period is soon ending in December 2023.

Already in May 2022, the European Commission has amended Annex VI Part 3 of Regulation (EC) No 1272/2008 on classification, labeling and packaging of substances and mixtures (CLP Regulation) by Delegated Regulation (EU) 2022/692. These regular amendments are due to Adaptation to Technical and Scientific Progress (short ATP). This is the 18th adaptation.

There is a transition period for compliance with the new or updated harmonized classifications. This gives suppliers the opportunity to adapt the labeling and packaging of substances and mixtures to the new or amended classification and to sell any remaining stocks in accordance with the previously applicable regulations. The regulation therefore applies from December 1, 2023, latest.

The new regulation added 39 new entries to Table 3 of Part 3 of Annex VI to CLP (including two dibutyltin analogues, bisphenol S (BPS) as a category 1B reproductive toxicant, benzophenone as a category 1B carcinogen, and melamine as a category 2 carcinogen). In addition, 17 entries were revised (including bisphenol A and butoxyethanol) and one entry was deleted (1,5-naphthylene diisocyanate).

Verify the use of the substances (new and changed) in your products and establish a strategy for the timing of the change and the subsequent information of your customers. The new classifications might also lead to changes in your safety data sheets and labels, as classification and labeling according to the CLP Regulation are affected.
