The ChemVerbotsV is a German regulation that governs the sale and handling of particularly hazardous chemicals. It defines strict rules for placing certain substances on the market, including requirements for documentation, customer information, and the appointment of a certified Sachkundige Person. Its purpose is to protect human health and the environment.
If your company sells, or distributes certain particularly hazardous substances (e.g., toxic, very toxic, or CMR substances), the ChemVerbotsV applies and you are usually required to appoint a Sachkundige Person. This also affects companies outside Germany that export restricted chemicals into the German market.
Commonly affected businesses include chemical distributors, specialty retailers, and manufacturers of dangerous substances or mixtures.

A Sachkundige Person is a legally required, certified expert who oversees compliance with the ChemVerbotsV. Their responsibilities include:

Without a Sachkundige Person, a company is not legally allowed to sell or distribute certain hazardous chemicals in Germany.
The regulation applies to particularly dangerous substances such as:
- CMR substances, i.e. Carcinogenic / Mutagenic / Reproductive toxic substances (Categories 1A, 1B under CLP)
- Substances or mixtures with acutely toxic effects under CLP (e.g. acute toxicity categories 1 or 2; H300, H310, H330)
- Substances with specific target organ toxicity (STOT), either single exposure (Category 1) or repeated exposure (Category 1 or possibly Category 2 depending on the substance) under CLP (e.g. H370, H372)
The exact list of substances is detailed in Anlage 2 of the ChemVerbotsV, which specifies the requirements for each substance or mixture. It's important to consult this annex to determine if your products fall under these regulations.
Currently, Annex 2 lists these substances with the following hazard pictograms: GHS02, GHS03, GHS06, or GHS08 in combination with certain H statements, such as H224, H241, H242, H340, H350, H350i, H360, H360F, H360D, H360FD, H360Fd, H360Df, H370, or H372.
