REACH - a Continuous Process in Chemical Compliance
On June 1, 2007, the EU Regulation 1907/2006, better known as the Regulation concerning the Registration, Evaluation, Authorization and Restriction of Chemicals (REACH), came into force.
The regulation obliges both EU manufacturers and importers of substances (as such, as components of mixtures and under certain conditions also as components in articles) to register them in Europe and to assure a safe use for humans, animals and the environment of these chemicals.
The obligation to register starts as soon as the production or import volume of a substance exceeds 1 metric ton per year. By registering, manufacturers and importers secure the right to market their chemicals in Europe. Non-EU manufacturers can appoint an Only Representative (OR) to cover their EU clients. In the subsequent supply chain, all downstream users are exempted from the registration obligation. However, you must ensure that your specific use(s) of the substance are covered by the registration.
In addition to the requirement to keep the registration dossier up to date, there are two more obligations for registrants arising from the REACH regulation, which come into effect after the registration of a substance In case of a dossier or substance evaluation, they are obliged to react to the requirements of the authorities. The aim is to ensure an adequate amount of qualitative data is available to evaluate each substance for its hazard profile.
Once substances are evaluated, they may be identified as Substances of Very High Concern (SVHC) and potentially require authorization. Applying for authorization allows you to further use substances for a certain amount of time even though they are effectively banned from usage on the European market.
